What is a Settlement Agreement

A settlement agreement (formally known as a compromise agreement) is a formal written agreement between an employer and an employee detailing the terms upon which an employee exits their employment.
The usual outcome of a settlement agreement will be that the employer pays a sum of money to the employee, and in return, the employee agrees not to bring any claims against the employer.
A settlement agreement can only become valid when the employee receives advice from a suitably qualified, insured and experienced Solicitor or Trades Union representative. The Solicitor has to provide a certificate to confirm the guidance and make the agreement effective and legally binding. This is why using a specialist settlement agreement solicitor is particularly important when negotiating an exit package.
